These regulations include a set of rules for staying at the Resort located in Biały Dunajec, ul. Za torem 14a. The Resort Operator is ORTUSTELLA sp. z o. o. with its registered office in Biały Dunajec, ul. Za torem 14A
Starting the stay at the Resort is tantamount to accepting the provisions of these regulations by the Guest, to which the Guest declares that he or she agrees.
1. The residential premises in the Resort, hereinafter referred to as "rooms", are rented for days.
2. The stay day lasts from 2:00 p.m. to 12:00 p.m. Staying in the room or leaving things after 12:00 p.m. is treated as an extension of stay. In the event that the Guest leaves the room after 12:00 p.m. - the Reception computer program will charge a fee for another day of renting the room at full prices.
3. At the request of the Client, the Resort Operator may extend the stay beyond the period indicated in the reservation or on the day of the Client's arrival at the Resort. The request should be submitted no later than 10:00 on the day on which the Client's room rental period expires.
4. The Resort Operator will consider the wishes to extend the stay to the extent possible. Failure to consider the request to extend the stay does not give rise to any legal or factual rights on the part of the Client.
5. The Guest may not transfer the room to other people even if the period for which he or she paid the fee has not expired.
6. In the case of an earlier reservation, an advance payment of 30% of the gross amount of the stay is applied. The Guest will be charged the full price of the stay in the event of cancellation of the reservation after 48 hours before arrival. We do not guarantee accommodation to persons who do not have a reservation and this payment.
7. The advance payment is non-refundable. The reservation can be moved to another convenient date (subject to availability of accommodation) in the event of cancellation up to 21 days before the planned arrival.
8. Failure to use the entire stay by the Guest due to a later arrival or earlier departure than indicated in the reservation does not result in a reduction in the payment for the service.
9. The payment for the stay is collected on the day of the Guest's arrival at the Resort.
10. Guests are required to check in immediately after arrival. In order to confirm their identity, the person checking in is required to show an identity document with a photograph.
11. We do not provide any information about the personal data of registered Guests of our Resort to third parties.
12. The Resort has a night silence from 10:00 p.m. to 7:00 a.m.
13. Persons not registered at the Resort may stay in the room from 7:00 a.m. to 8:00 p.m.
14. The Guest is financially liable for any damage or destruction of equipment and technical devices caused by their fault or the fault of people visiting them. The Resort Operator reserves the right to charge the Guest's credit card for any damage caused after their departure.
15. The reception desk may refuse to accept a Guest who, during their previous stay, grossly violated the Regulations by causing damage on behalf of the Resort or Guests, or damage to the persons of Guests, employees or other persons staying at the Resort, or in any other way disturbed the peaceful stay of Guests or the functioning of the Resort. Such a person is obliged to immediately comply with the demands, in particular to pay for the damage and destruction caused and to leave the Resort premises.
16. At the time of check-in, the Guest is issued an electronic key to the room. When leaving the room, the Guest is obliged to carefully check if the door to the room is closed. In the event of loss or destruction of the card or key, the Guest is financially liable in the amount of PLN 50.
17. When the Reception gives you the room card, you become its host. Rooms are cleaned every 3 days or at the Guest's request. To do this, you must report it to the Reception.
18. Due to fire safety, it is forbidden to use heaters, electric irons and other similar devices that are not part of the room equipment in the rooms. This does not apply to chargers and power supplies for RTV and computer equipment.
19. In accordance with the Act of April 8, 2010 amending the Act on the protection of health against the effects of using tobacco and tobacco products and the Act on the State Sanitary Inspection (Journal of Laws No. 81, item 529) - there is a total ban on smoking cigarettes and tobacco products on the premises of the Resort. In the Resort, there is a total ban on consuming your own alcoholic beverages outside the Resort rooms, using open fire, in particular in rooms and bathrooms. In the event of a breach of the above-mentioned prohibitions, the Guest will be subject to a fine of PLN 500. Triggering a false fire alarm will result in the arrival of the fire brigade and a fine of PLN 5,000.10 The Resort provides services in accordance with the category and standard of the Resort. In the event of any reservations regarding the quality of services, the Guest is requested to report them to the Reception as soon as possible,
20. The Resort Operator is obliged to ensure:
a) conditions for full and unrestricted relaxation of the Guest,
b) professional and courteous service within the scope of the services provided,
c) performance of necessary repairs of devices during the Guest's absence, and in their presence only if they express such a wish.
d) technically efficient service. In the event of faults that cannot be repaired, the Reception will make every effort to change the room to the extent possible or to alleviate the inconvenience in another way.
21. The Resort accepts the presence of animals. Animals may stay on the premises of the Resort for an additional fee. However, the owner of the animal is obliged to keep it in such a way that it does not pose a threat to other Guests and staff. The Guest is obliged to remove any waste left by the animal on the premises of the Resort. In such a case, the price of the stay will be individually agreed with the Guest
22. The Resort Operator is not responsible for the loss or damage of money, securities, valuables, other items and valuables or items of scientific or artistic value, if these items are not deposited at the Reception Desk. The parking lot at the Resort is unguarded and free of charge. The Resort Operator is not responsible for the destruction or theft of a car or other vehicle belonging to a Resort Guest.
23. The following is prohibited in the Resort:
a) taking food out of the restaurant area
b) disturbing the peace (e.g. playing or performing loud music without the consent of the Management)
c) walking in ski boots in the Resort and bringing ski equipment into the rooms
d) storing dangerous goods - weapons and ammunition, flammable, explosive and illuminating materials
e) conducting canvassing and mobile sales in the Resort
f) behavior generally considered indecent
24. Persons violating the rules of these regulations will be required to immediately leave the Resort and pay for the services used.
25. Personal items left by a departing Guest will be sent at their expense to the indicated address. In the event of failure to receive such an instruction, these items will be stored for a month and then destroyed.
26. Children under 12 years of age should be in the Resort under the constant supervision of their legal guardians. Legal guardians are financially liable for any damage caused by children.
27. Each time a Guest leaves the room, for safety reasons, they should turn off the TV, turn off the lights, close the taps and lock the door.
28. Upon making a reservation at the Resort, the Guest declares that they consent to the storage and processing of personal data in accordance with the Personal Data Protection Act (Journal of Laws of 2002, No. 101, item 926, with subsequent amendments) by the Resort Operator, i.e. ortustella sp. z o. o. at ul. Za Torem 14A, for the purposes necessary to implement the Guest's stay at the Resort, the Guest's use of other services provided by the Resort. The Guest has the right to view and correct their personal data, as well as to request the removal of their personal data from the collection.
29. The Resort Operator reserves the right to change the Resort Regulations at any time. The change to the Regulations is effective from the moment it is posted on the Resort's website. The change of the Regulations is binding on Guests from the moment it is published on the Resort Operator's website.
RESERVATION AND PAYMENT REGULATIONS
1. Confirmation of the reservation is the payment of an advance payment of no less than 30% of the reservation value to the provided bank account.
2. The deadline for payment of the advance payment is set by the Reception.
3, Failure to pay the advance payment by the agreed date will result in automatic cancellation of the reservation.
4, The Resort Operator will take into account requests to extend the stay to the extent of the available places.
5. Payment of the advance payment and thus making an effective reservation means acceptance of the terms of the reservation specified in these regulations and the resort regulations by the person making the reservation.
6. Failure to use the entire stay by the Guest due to later arrival or earlier departure than indicated in the reservation will not result in a reduction in the payment for the service.
7. Failure of the Guest to show up by 10 a.m. 9:00 the following day (arrival the next day) is equivalent to canceling the reservation and the possibility of renting the room to another Guest, unless otherwise agreed. In such a case, the Resort Operator does not bear any negative consequences, both legal and financial.
8 The remaining amount due for the stay must be paid on the day of arrival.
9. The Resort Operator has a statutory lien on items brought by the Guest to the Resort in the event of a delay in settling payment for the stay or failure to pay for services provided.
REGULATIONS FOR BOOKING ACCOMMODATION SERVICES BY ELECTRONIC MEANS (hereinafter referred to as "REGULATIONS")
INTRODUCTORY PROVISIONS: These regulations are a standard contract for bookings and define the rights and obligations of the Facility and the Client.The condition for making a booking is to complete the form, read and accept the provisions of the Regulations and make the payment. The Client makes the booking voluntarily. The Facility does not charge a booking fee. The Regulations apply to reservations made from 01.03.2025. The following terms used in the Regulations shall have the meaning established in accordance with the definitions below:
CUSTOMER: - a natural person who is at least 18 years old and has full legal capacity (consumer) or in the case of a reservation made for a company, a person who, in connection with their profession or service provided to a legal person and/or an organizational unit that is not a legal person, to which the law grants legal capacity, makes a reservation in its name and on its behalf (not a consumer);

ONLINE PAYMENT: online payment methods made available to the Customer by the Facility as part of the booking process.
TECHNICAL REQUIREMENTS: To make a booking, an Internet connection and an e-mail account are required, to which a message confirming the booking is sent (in the event of completion of the booking process) or an e-mail about the cancellation of the booking (in the event of failure to complete the booking process). For assistance or answers to any questions, please contact the Facility directly.
MOMENT OF BOOKING: The booking is considered to be made when the facility accepts the booking request - sending an e-mail to the Client with confirmation of the booking. In the event of not receiving an e-mail, please check your SPAM message or contact the facility. Children up to 3 years of age stay for free if they sleep in their parents' bed. The facility operator takes into account requests to extend the stay to the extent that there are places available.
CHANGE OF BOOKING: Changing the booking by the Client involves the following steps: The Client sends a message to rezerwacje@resortspa.pl about the change of date or room configuration, by providing the booking number and the name and surname provided when making the booking. Please remember that until you contact the facility and confirm the modification by the facility, it is not made.
REFUSAL OF BOOKING: The facility reserves the right to refuse a booking if there are no available rooms in the facility. In such a case, the Client will automatically receive a message to the Client's e-mail address provided during the booking process, stating that it is not possible to make the reservation.
CANCELLATION/REVOKING OF A RESERVATION: Cancellation of a reservation by the Client involves the following steps: Send an e-mail requesting cancellation to rezerwacje@resortspa.pl, providing the reservation number, First name and Last name provided during the booking process after cancelling the reservation, the Client will receive, to the e-mail address provided during the booking process, a message containing confirmation of the cancellation of the reservation, and in the event of a free cancellation and previous payment for the reservation, the amount paid will be refunded to the Client to the account from which the payment was made as part of the booking. Please remember that receiving confirmation of the cancellation of the reservation is equivalent to cancellation of the reservation. If you do not receive confirmation of cancellation of your reservation, please check your SPAM folder and contact the Facility.
NOTES ON BOOKING: Comments entered in the form do not bind the Facility in any way. The Facility does not guarantee their fulfillment. The Facility reserves the right to contact the Client by e-mail or telephone to discuss them and inform about payment (both earlier and on the day of arrival), if fulfilling the comments/requests requires it and their implementation only after acceptance by the Facility and the Client.
ADDITIONS: The additions selected in the reservation are binding on the Facility and if it is necessary to deliver them to the room, this delivery
will take place to the room at the latest upon the Client's arrival, unless the Client and the Facility decide otherwise by separate arrangements. In the case of personalizing the addition, please contact the Facility in advance to determine the possibility of personalization (e.g. selection of types of flowers, color, etc.).
PAYMENT: The customer can pay for the reservation via Online Payments or by bank transfer. The order is associated with the obligation to pay. To confirm the reservation, a payment of 30% of the reservation value is required, which is non-refundable, within 72 hours from the date of submission of the reservation, unless the price offer, including the conditions for canceling the price offer, provides otherwise. In the event that the advance payment is not credited to our bank account within 72 hours from the time of submission of the reservation, the reservation will be canceled automatically. Payment of the advance payment and thus making an effective reservation means acceptance of the reservation conditions specified in these regulations and the regulations of the Facility by the person making the reservation. The remaining amount due for the stay must be paid on the day of arrival at the reception desk. No-show of the Guest by 10:00 p.m. 9:00 the following day (arrival on the next day) is tantamount to cancellation of the reservation and the possibility of renting the room to another Guest, unless otherwise agreed. In such a case, the Facility Operator does not bear any negative consequences, both legal and financial. The Resort Operator has the statutory right of lien on items brought by the Guest to the Resort in the event of a delay in settling payment for the stay or failure to settle the amount due for the services provided.
HOTEL STAY: The terms and conditions of the hotel stay are specified in separate regulations of the Facility. The reservation terms and conditions apply directly and in the event of non-compliance with the Facility regulations, they take precedence.
RIGHTS AND OBLIGATIONS: The Client agrees to comply with the conditions in force at the Facility, including, but not limited to, the Facility regulations and to settle all dues on time, as well as to comply with all guidelines, rules and restrictions, in particular those imposed by law or recommendations of relevant authorities and services that are in force at the Facility. The Client is obliged to use true data, including personal data, which they have the right to use. The Client undertakes not to take any actions that are inconsistent with the provisions of generally applicable law or good customs. The Facility undertakes to implement the terms of the reservation made. The Facility reserves the right to block the e-mail address of a Client who has violated the provisions of the Regulations or legal provisions.
LIABILITY: The Client is solely responsible for the selection of the reservation and its suitability for their own needs and those of the people for whom they make the reservation. The Client is responsible for their own actions and omissions, including providing incorrect information or failure to comply with the Regulations. The Facility or the provider of the reservation engine on the website is not responsible for interrupting the reservation process at the stage of filling out the form or the so-called abandonment of the shopping cart (failure to complete the reservation) by the Client. The Client must start filling out the booking form again. Departure before the booked check-out date does not affect the price and is equivalent to charging a fee in accordance with the terms of the booking. The Facility or the provider of the booking engine on the website is not responsible for incorrectly entered data by the Client, lack of access to the Internet or limitations in its availability, limitations and/or improper operation of the software or devices belonging to the Client, which are the basis for making the booking, damages incurred and lost profits by the Client, which were caused as a result of the actions and/or omissions of third parties, and which were beyond the control of the Facility, damages incurred and lost profits by the Client, which were caused as a result of force majeure, payments made as part of Online Payments. The exclusions or limitations of liability provided for in the Regulations do not apply in cases where, due to the content of mandatory provisions of law, it is not possible to exclude
or limit liability, in particular they do not apply to damage caused intentionally. All claims are subject to a limitation period in accordance with applicable provisions of law.
COMPLAINTS: The Client has the right to file a complaint and have it considered by the Facility within the statutory period of 14 days from its receipt. Please submit complaints by letter or electronically to the Facility's address. The complaint should contain the following data of the Client: first name, last name, Client's address, e-mail address provided when booking and a description of the problem that occurred. Immediately after considering the complaint, the Facility will provide the Client with a response regarding the resolution. The response will be sent in the same form in which the complaint was submitted. PERSONAL DATA AND PRIVACY: The principles of personal data processing and the terms of privacy protection are specified in the Privacy Policy on the Facility's website.

FINAL PROVISIONS: The Facility has the right to introduce changes to the Regulations and they are effective upon update in the booking engine on the website, provided that the Customer who made the reservation is bound by the Regulations in the version in force on the date of acceptance of the Regulations by the Customer. In the event of a violation of the law by a person, this person is obliged to contact the Facility. In matters not regulated in the Regulations, the relevant provisions of Polish law and/or regulations applicable to the place of residence of the consumer law apply. In the event of a change and/or invalidation as a result of a final court decision of any of the provisions of the Regulations, the remaining provisions remain in force. The Facility declares its readiness to resolve disputes in an amicable manner, including pursuing claims in out-of-court ADR (Alternative Dispute Resolution) mode. The authorized entity to which the complaint can be directed depends on the consumer's choice. The register of such entities in Poland, together with their contact details and website address, can be found here: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php Any disputes between the Facility and the Customer who started making or made a reservation not as a consumer will be resolved by the court with local jurisdiction for the Facility's registered office. The applicable law is Polish law, and the basis for interpretation is the Regulations in Polish.
